Strata & building defects

In Sydney, so much of what is for sale is an apartment, and with a strata place the strata report tells you far more than the listing ever will. We read the capital-works fund, the levies, the by-laws and the minutes for any defect, cladding or special-levy history, the kind of thing that made headlines at Opal and Mascot Towers, so the building's problems are yours to weigh up rather than inherit. If it is a newer tower, we also check the building bond and defect protections that now sit behind NSW apartments.

Exchange, cooling-off & the contract

Sydney moves fast, and to head off gazumping a lot of buyers exchange unconditionally, with their conveyancer signing a section 66W certificate that waives the five-day cooling-off. We only suggest that once we have read the contract, because after a 66W exchange there is no backing out. The contract also has to carry its prescribed documents, including the section 10.7 planning certificate that shows zoning and any heritage listing, common on the terraces around Paddington, Balmain and Glebe, plus the Sydney Water sewer diagrams. We go through all of it before you sign.

Flood & bushfire land

Risk in Sydney really depends on where you are looking. There is flood-planning land along the Georges and Hawkesbury-Nepean rivers, bushfire-prone land out on the bush fringe from Hornsby to Sutherland, and in the inner west a history of industry that can leave contaminated land behind. All of it shows on the section 10.7 planning certificate, and we read it closely before you commit.

Adjustments

Council rates & Sydney Water

Greater Sydney is carved up into more than thirty councils, and water and sewerage are billed separately again by Sydney Water. Both get shared between you and the seller at settlement. We confirm the right council, get the rates and water adjustment right, and flag any arrears or charges that would otherwise follow the title to you.

Do I need a conveyancer based in Sydney?

No. Zettle is a fully online conveyancing service covering all of New South Wales, so your conveyancer does not need to be in Sydney. Everything, from the contract review to exchange and settlement through PEXA, is handled online wherever you are.

How long is the cooling-off period in New South Wales?

Five business days from exchange for a private-treaty purchase, though it is often waived with a section 66W certificate. There is no cooling-off period when you buy at auction. Withdrawing during it forfeits 0.25% of the purchase price.

What should the strata report show before I buy an apartment in Sydney?

A strata report should show the capital-works (sinking) fund balance, the quarterly levies, any special levies, the by-laws, and the minutes for defect, cladding or dispute history. In Sydney's apartment market this is the single most important check, and we review it before you exchange.

How long does settlement take in New South Wales?

In New South Wales, settlement is typically around 42 days (six weeks) from exchange, though the exact period is set in the contract. Your conveyancer manages the timeline through to completion.
